Please take a moment now to hear the story of our beloved family member, Floyd England.
Floyd was sentenced in federal court to 40 yrs without parole, under the mandatory minimum laws for a first time nonviolent drug charge. A little harsh, don't you think?
To make matters worse, 20 of those years were "sentencing enhancements", 10 years for charges the jury had not heard at trial and 10 years for charges the jury had found him to be NOT GUILTY! I had no idea this was even possible!!! Did you?
Federal judges have called Floyd's sentence "Draconian", and the Supreme Court has since ruled that this type of sentencing is unconstitutional, but because of new appeallate laws, Floyd is unable to appeal his sentence since the Supreme Court's ruling.
His only hope now is for a change in the appeallate law or a commutation of his sentence.
Floyd has already served 20 incident free years of the 40 years he was given for his mistake. He has educated himself and received numerous degrees. He also volunteers much of his time teaching other inmates how to read. He is truly a good guy who made a non-violent mistake for money 20 years ago. He has done his time, and then some. He and his family, me included, have suffered enough without him.
